Article R441-7-5 of the French Insurance Code

Undertakings reinsuring commitments under an agreement on a uniform proportional basis apply articles R. 441-7 to R. 441-7-3, R. 441-12 and R. 441-21.

For the purposes of these articles, the following definitions apply: “the treaty” where “the agreement” is mentioned, “the reinsurer” where “the insurance undertaking” is mentioned and “the ceding undertaking” where “the beneficiaries” are mentioned.

Article R441-7-5

Les entreprises réassurant proportionnellement de manière uniforme les engagements d’une convention appliquent à ce titre les articles R. 441-7 à R. 441-7-3, R. 441-12 et R. 441-21.

Pour l’application de ces articles, il y a lieu d’entendre : “ le traité ” là où est mentionnée : “ la convention ”, “ le réassureur ” là où est mentionnée : “ l’entreprise d’assurance ” et “ la cédante ” là où sont mentionnés : “ les bénéficiaires ”.
