Article R441-9 of the French Commercial code

The application shall include all the information and supporting documents needed to assess whether the trader is covered by the provisions of article L. 441-15.

If the application is incomplete, the department shall ask the applicant to provide the necessary additional information, in the same form as the application.

La demande comprend toutes les informations et pièces justificatives permettant d’apprécier si le professionnel relève des dispositions de l’article L. 441-15.

Si la demande est incomplète, le service invite son auteur à fournir les éléments complémentaires nécessaires, dans les mêmes formes que la demande.

La demande, la liste des éléments complémentaires demandés par l’administration et la notification de la position formelle, ou de la nouvelle position formelle mentionnée à l’article R. 441-10, sont déposées ou adressées par tout moyen permettant d’apporter la preuve de la date de leur réception.

Un arrêté du ministre chargé de l’économie établit la liste des informations nécessaires à l’instruction de la demande, les pièces justificatives qui l’accompagnent et le formulaire de demande.
