Article R4413-10 of the French General Code of Local Authorities

The Board of Directors regulates the affairs of the agency through its deliberations.

It deliberates in particular on:

1° The budget and the administrative account;

2° Borrowings;

3° General action programmes, and in particular multiannual programmes;

4° The annual activity report;

5° Measures relating to the general organisation of the agency;

6° The acquisition and disposal of assets necessary for the operation of the agency;

7° Staff numbers and recruitment conditions, in compliance with the provisions of Law no. 84-53 du 26 janvier 1984 portant dispositions statutaires relatives à la fonction publique territoriale;

8° The conclusion of the agreements referred to in article R. 4413-2;

9° The agency’s contribution to studies;

10° The general conditions for awarding grants and loans;

11° The allocation of these grants and loans;

12° The operations provided for in 3° of Article R. 4413-1;

13° The acceptance of donations and legacies;

14° Legal actions.

The Board of Directors may delegate some of its powers to its Executive Committee, with the exception of those relating to the vote on the budget, loans, approval of the administrative account and measures of the same nature as those referred to in Article L. 1612-15.

Article R4413-10

Le conseil d’administration règle par ses délibérations les affaires de l’agence.

Il délibère notamment sur :

1° Le budget et le compte administratif ;

2° Les emprunts ;

3° Les programmes généraux d’action, et notamment les programmes pluriannuels ;

4° Le rapport annuel d’activité ;

5° Les mesures relatives à l’organisation générale de l’agence ;

6° L’acquisition et l’aliénation des biens nécessaires au fonctionnement de l’agence ;

7° Les effectifs et les conditions de recrutement du personnel, dans le respect des dispositions de la loi n° 84-53 du 26 janvier 1984 portant dispositions statutaires relatives à la fonction publique territoriale ;

8° La conclusion des conventions visées à l’article R. 4413-2 ;

9° La contribution de l’agence aux études ;

10° Les conditions générales d’attribution des subventions et des prêts ;

11° Les attributions de ces subventions et prêts ;

12° Les opérations prévues au 3° de l’article R. 4413-1 ;

13° L’acceptation des dons et legs ;

14° Les actions en justice.

Le conseil d’administration peut déléguer une partie de ses attributions à son bureau, à l’exception de celles relatives au vote du budget, des emprunts, à l’approbation du compte administratif et aux mesures de même nature que celles visées à l’article L. 1612-15.
