Article R442-10-2 of the French Insurance Code

The political risk is realised

1° When the goods cannot be dispatched or cannot leave the country of dispatch or do not reach the country of destination as a result of one of the following incidents occurring in the country of dispatch or in transit:

a) Export ban imposed by the authorities of the country of dispatch;

b) Capture, arrest, seizure, requisition, coercion, molestation or detention by a foreign government or authority;

c) Civil or foreign war, revolution, riot or other similar events.

2° If the goods, as a result of an event occurring in the country of dispatch or during transit and resulting directly from one of the causes mentioned in 1° above, are destroyed or damaged or are subject to additional costs which are not recoverable from the seller.

Le risque politique est réalisé :

1° Lorsque la marchandise ne peut être expédiée ou ne peut sortir du pays expéditeur ou ne parvient pas au pays de destination par suite de l’un des incidents suivants survenus dans le pays expéditeur ou en cours de transit :

a) Interdiction d’exportation édictée par les autorités du pays expéditeur ;

b) Capture, arrêt, saisie, réquisition, contrainte, molestation ou détention par un Gouvernement étranger ou une autorité étrangère ;

c) Guerre civile ou étrangère, révolution, émeute ou autres faits analogues.

2° Lorsque la marchandise, par suite d’un fait survenu dans le pays expéditeur ou en cours de transit et résultant directement de l’une des causes mentionnées au 1° ci-dessus, est détruite ou endommagée ou est grevée de frais supplémentaires non récupérables sur le vendeur.
