Failure to implement procedures for the withdrawal or recall of a foodstuff other than a product of animal origin or a foodstuff containing such a product that is unfit for consumption, within the meaning of Article 14(5) of amended Regulation No 178/2002 of the European Parliament and of the Council of 28 January 2002 laying down the general principles and requirements of food law, establishing the European Food Safety Authority and laying down procedures in matters of food safety as provided for in Article 19 of the same Regulation shall be punishable by a fine for a 5th class offence.
Recidivism is punishable in accordance with the provisions of articles 132-11 and 132-15 of the Penal Code.
