Failing to make the declaration provided for in the fifth paragraph of article L. 423-3, or to provide inaccurate or incomplete information, is punishable by the fine laid down for 5th class offences.
The fine is incurred as many times as there are products concerned by the recall.
Recidivism is punishable in accordance with articles 132-11 and 132-15 du code pénal.
Le fait de ne pas procéder à la déclaration prévue au cinquième alinéa de l’article L. 423-3, ou de communiquer des informations inexactes ou incomplètes, est puni de l’amende prévue pour les contraventions de la 5e classe.
L’amende est encourue autant de fois qu’il y a de produits concernés par le rappel.
La récidive est réprimée conformément aux articles 132-11 et 132-15 du code pénal.
