Article R4523-2 of the French Labour Code

The Social and Economic Committee may decide to call upon the technological risk expert referred to in Article L. 4523-5 when applying for the prefectoral authorisation provided for in Article L. 512-1 of the Environment Code and before issuing the opinion provided for in Article R. 4612-4.
The Committee may take its decision as from the meeting during which it is informed of the documents attached to the application for authorisation submitted to the Prefect,
This expert, chosen after consultation with the department responsible for the application for authorisation, submits his report to the Committee before the close of the public enquiry. The expert will present the report at a committee meeting before the committee is consulted on the dossier as a whole.

Le comité social et économique peut décider de faire appel à l’expert en risques technologiques mentionné à l’article L. 4523-5 à l’occasion de la demande d’autorisation préfectorale prévue par l’article L. 512-1 du code de l’environnement et avant d’émettre l’avis prévu à l’article R. 4612-4.
Le comité peut prendre sa décision à compter de la réunion au cours de laquelle il est informé sur les documents joints à la demande d’autorisation communiquée au préfet,
Cet expert, choisi après consultation du service instructeur de la demande d’autorisation, remet son rapport au comité avant la clôture de l’enquête publique. Il le présente en réunion du comité avant la consultation de ce dernier sur l’ensemble du dossier.
