Article R4624-45-6 of the French Labour Code

The worker is informed, when his occupational health medical record is created and during the situations provided for in article R. 4624-45-7, by any means including electronic means:

1° Of his right to object to access to the occupational health medical record, by the corresponding medical practitioner or the professionals responsible for monitoring his state of health, under the authority of the occupational physician ;

2° of his right to object to access by the professionals responsible for monitoring his state of health to the occupational health medical records which he holds and which are held by other prevention and occupational health services.

The provision of this information and the exercise of one of these rights are recorded in the occupational health medical record in accordance with Article R. 4624-45-4.

Le travailleur est informé, lors de la création de son dossier médical en santé au travail et lors des situations prévues à l’article R. 4624-45-7, par tout moyen y compris dématérialisé :

1° De son droit de s’opposer à l’accès au dossier médical en santé au travail, du médecin praticien correspondant ou des professionnels chargés d’assurer, sous l’autorité du médecin du travail, le suivi de son état de santé ;

2° De son droit de s’opposer à l’accès des professionnels chargés du suivi de son état de santé aux dossiers médicaux en santé au travail dont il est titulaire et qui sont détenus par d’autres services de prévention et de santé au travail.

La délivrance de ces informations et l’exercice de l’un de ces droits sont retracés dans le dossier médical en santé au travail conformément à l’article R. 4624-45-4.
