Article R4624-45-8 of the French Labour Code

The worker, or in the event of his death any person authorised by Articles L. 1110-4 and L. 1111-7 of the Public Health Code, may request communication of his occupational health medical file in paper or dematerialised form.

The worker may also exercise his rights of rectification, erasure and restriction, as provided for in Articles 16 to 18 of Regulation (EU) 2016/679, with the occupational health and prevention service.

Subject to the provisions of Article R. 4624-45-6, the right to object does not apply to the constitution and supply of the occupational health medical file.

Le travailleur, ou en cas de décès de celui-ci toute personne autorisée par les articles L. 1110-4 et L. 1111-7 du code de la santé publique, peut demander la communication de son dossier médical en santé au travail sous format papier ou dématérialisé.

Le travailleur peut également exercer ses droits de rectification, d’effacement et de limitation, prévus aux articles 16 à 18 du règlement (UE) 2016/679, auprès du service de prévention et de santé au travail.

Sous réserve des dispositions prévues à l’article R. 4624-45-6, le droit d’opposition ne s’applique pas à la constitution et à l’alimentation du dossier médical en santé au travail.
