Article R4626-12 of the French Labour Code

The establishment informs the establishment’s technical committee, the social and economic committee and the regional director of companies, competition, consumption, labour and employment of the appointment or recruitment of the occupational physician.

Without prejudice to the regulatory provisions applicable in disciplinary matters to the staff referred to in article L. 952-21 of the Education Code and in 1° of article L. 6152-1 of the Public Health Code, the decision to dismiss the occupational physician or to terminate or not renew his fixed-term contract is taken after receiving the assent of the Labour Inspector. This opinion is given after consultation of the competent social and economic committee and the opinion of the labour inspector.

L’établissement informe le comité technique d’établissement, le comité social et économique et le directeur régional des entreprises, de la concurrence, de la consommation, du travail et de l’emploi de la nomination ou du recrutement du médecin du travail.

Sans préjudice des dispositions réglementaires applicables en matière disciplinaire aux personnels visés à l’article L. 952-21 du code de l’éducation et au 1° de l’article L. 6152-1 du code de la santé publique, la décision de licenciement du médecin du travail, de rupture ou de non-renouvellement de son contrat à durée déterminée est prise après avis conforme de l’inspecteur du travail. Cet avis est rendu après consultation du comité social et économique compétent et avis du médecin inspecteur du travail.
