Article R4644-2 of the French Labour Code

The intervention of the occupational risk prevention consultant registered under the conditions laid down in section 2 is subject to the conclusion of an agreement between the latter and the employer or the president of the inter-company occupational health service.

This agreement specifies:

1° The activities entrusted to the occupational risk prevention consultant and the procedures for carrying them out;

2° The resources made available to the consultant and the rules defining his access to workplaces and the performance of his duties, in particular the presentation of his proposals, under conditions which ensure his independence.

Article R4644-2

L’intervention de l’intervenant en prévention des risques professionnels enregistré dans les conditions prévues à la section 2 est subordonnée à la conclusion d’une convention entre celui-ci et l’employeur ou le président du service de santé au travail interentreprises.

Cette convention précise :

1° Les activités confiées à l’intervenant ainsi que les modalités de leur exercice ;

2° Les moyens mis à la disposition de l’intervenant ainsi que les règles définissant son accès aux lieux de travail et l’accomplissement de ses missions, notamment la présentation de ses propositions, dans des conditions assurant son indépendance.
