For the purposes of Article L. 511-1, any natural person or legal entity is deemed to be making a presentation, offer or assistance in concluding an insurance transaction if it solicits or obtains the subscription of a contract or membership of such a contract, or explains the terms of cover of a contract orally or in writing to a potential subscriber with a view to such subscription or membership.
The work preparatory to the conclusion of an insurance or reinsurance contract referred to in I of Article L. 511-1 includes, on the one hand, all work relating to the management of networks of insurance or reinsurance product distributors or the organisation by an insurance intermediary of the network of insurance intermediaries or insurance intermediaries on an ancillary basis to which he has recourse and, on the other hand, all analytical and advisory work carried out with a view to the presentation, proposal or conclusion of a contract. They do not include activities consisting of providing information or advice on an occasional basis in the context of a professional activity other than that mentioned in the first paragraph.
