Article R512-25 of the French Monetary and Financial Code

Members of the Crédit Mutuel network are notified of the sanctions to which they are liable and invited to express their observations or to be represented at the meeting of the Confédération Nationale du Crédit Mutuel at which their case will be examined.

The Board of Directors of the Confédération decides on sanctions by a two-thirds majority of the members present.

Sanction decisions are substantiated, brought to the attention of the Autorité de contrôle prudentiel et de résolution and notified to the member concerned.

The decision to remove an entity from the list provided for in Article R. 512-21 may be referred within two months by the entity concerned or, where applicable, by the federation to which it is attached, to the general meeting of the confederation, which shall give its decision within three months by a majority of its members present or represented.

If the deregistration is confirmed, the entity concerned may appeal to the competent court.

Les affiliés du réseau du crédit mutuel sont avisés des sanctions qu’ils encourent et invités à exprimer leurs observations ou à se faire représenter à la séance de la Confédération nationale du crédit mutuel au cours de laquelle leur cas sera examiné.

Le conseil d’administration de la confédération prononce les sanctions à la majorité des deux tiers des membres présents.

Les décisions de sanctions sont motivées, portées à la connaissance de l’Autorité de contrôle prudentiel et de résolution et notifiées à l’affilié intéressé.

La décision de radiation de la liste prévue à l’article R. 512-21 peut être déférée dans les deux mois, par l’entité concernée ou, le cas échéant, par la fédération à laquelle elle est rattachée, à l’assemblée générale de la confédération, qui statue dans un délai de trois mois à la majorité de ses membres présents ou représentés.

Si la radiation est confirmée, l’entité concernée peut se pourvoir devant la juridiction compétente.
