Article R5123-24 of the French Labour Code

The allowance may only be paid by the State if the company has included in its collective labour agreement provisions relating to forward-looking employment management, the development of its employees’ skills and their adaptation to changes in their jobs. The agreement or collective labour agreement also determines the maximum number of beneficiaries of the allowance for the membership period defined by the professional agreement.

La prise en charge de l’allocation par l’Etat ne peut intervenir que si l’entreprise a prévu par convention ou accord collectif de travail des dispositions relatives à la gestion prévisionnelle de l’emploi, au développement des compétences de ses salariés et à leur adaptation à l’évolution de leur emploi. La convention ou l’accord collectif de travail détermine également le nombre maximum de bénéficiaires de l’allocation pour la période d’adhésion définie par l’accord professionnel.
