Article R5123-39 of the French Labour Code

The national professional agreement and the company agreement cannot release the company from its commitments to the employees and in particular from the payment of the allowance when the financial participation of the State is suspended or interrupted in application of the provisions of this sub-section.

L’accord professionnel national et l’accord d’entreprise ne peuvent délier l’entreprise des engagements pris à l’égard des salariés et notamment du versement de l’allocation lorsque la participation financière de l’Etat est suspendue ou interrompue en application des dispositions de la présente sous-section.
