Article R5126-25 of the French Public Health Code

For advanced therapy medicinal products, including those prepared on an ad hoc basis as referred to in 4° and 5° of the I of Article R. 5126-9, the in-house pharmacy may organise, on the basis of an agreement, with an establishment or body authorised in accordance with the provisions of Articles L. 1243-2, L. 4211-9-1 or L. 4211-9-2, the storage, reconstitution or packaging in an appropriate form in accordance with the package leaflet or the research protocol involving the human person necessary for the dispensing of these medicinal products.

The agreement signed is sent to the authority mentioned in I or IV of article L. 5126-4.

Pour les médicaments de thérapie innovante y compris ceux préparés ponctuellement mentionnés aux 4° et 5° du I de l’article R. 5126-9, la pharmacie à usage intérieur peut organiser, sur la base d’une convention, avec un établissement ou organisme autorisé conformément aux dispositions des articles L. 1243-2, L. 4211-9-1 ou L. 4211-9-2, la conservation, la reconstitution ou la mise sous forme appropriée conformément à la notice ou au protocole de recherche impliquant la personne humaine nécessaires à la dispensation de ces médicaments.

La convention signée est transmise à l’autorité mentionnée au I ou au IV de l’article L. 5126-4.
