Article R5132-1-3 of the French Labour Code

The prescription of a pathway is suspended when the work contract within a structure mentioned in article L. 5132-4 is suspended for more than 15 days, broken or terminated.

The suspension is declared, by electronic means, using the teleservice mentioned in article R. 5132-1-19, by a prescriber or a structure for integration through economic activity.

After twelve consecutive months of suspension, a prescriber or a structure for integration through economic activity may terminate the prescription of the pathway, after examining the situation of the person concerned with regard to employment and the support and training actions carried out as part of the pathway. The person concerned is notified of this termination by any means that provides a date certain for receipt of the notification.

La prescription d’un parcours est suspendue lorsque le contrat de travail au sein d’une structure mentionnée à l’article L. 5132-4 est suspendu au-delà d’une durée de 15 jours, rompu ou a pris fin.

La suspension est déclarée, par voie dématérialisée, en utilisant le téléservice mentionné à l’article R. 5132-1-19, par un prescripteur ou une structure d’insertion par l’activité économique.

Au-delà de douze mois de suspension consécutifs, un prescripteur ou une structure d’insertion par l’activité économique peut mettre fin à la prescription du parcours, après examen de la situation de la personne concernée au regard de l’emploi et des actions d’accompagnement et de formation conduites dans le cadre du parcours. Cette interruption est notifiée à l’intéressé par tout moyen donnant date certaine à la réception de cette notification.
