Article R5132-32 of the French Labour Code

If the employer fails to comply with the provisions of the agreement, the Prefect will inform the employer by registered letter of his intention to terminate the agreement. The employer is given a period of not less than one month in which to make its observations known.

The Prefect may then demand repayment of any sums wrongly received.

En cas de non-respect des dispositions de la convention par l’employeur, le préfet l’informe par lettre recommandée de son intention de résilier la convention. Celui-ci dispose d’un délai, qui ne peut être inférieur à un mois, pour faire connaître ses observations.

Le préfet peut alors demander le reversement des sommes indûment perçues.
