Article R5132-37 of the French Labour Code

The recruitment of the people referred to in article L. 5132-1 on fixed-term contracts, or the employment of prisoners who have signed a prison employment contract, by organisations with an integration workshop or site agreement entitles them to financial assistance, up to the number of integration posts set by the agreement.

This aid comprises a base amount and a modulated amount. The adjusted amount is determined each year by the Prefect, under the conditions set out in article R. 5132-38, taking into account:

-the characteristics of the people hired and, where applicable, the prisoners who have signed a prison employment contract ;

-the actions and means of integration implemented;

-the results observed on leaving the facility.

Article R5132-37

L’embauche des personnes mentionnées à l’article L. 5132-1 en contrat à durée déterminée ou l’emploi des personnes détenues ayant signé un contrat d’emploi pénitentiaire par les organismes conventionnés au titre d’un atelier ou chantier d’insertion ouvre droit, dans la limite du nombre de postes d’insertion fixé par la convention, à une aide financière.

Cette aide comprend un montant socle et un montant modulé. Le montant modulé est déterminé chaque année par le préfet, dans les conditions fixées par l’article R. 5132-38, en tenant compte :

-des caractéristiques des personnes embauchées et, le cas échéant, des personnes détenues ayant signé un contrat d’emploi pénitentiaire ;

-des actions et des moyens d’insertion mis en œuvre ;

-des résultats constatés à la sortie de la structure.
