Article R521-7 of the French Commercial code

The applicant must attach to the form, as appropriate, the original deed constituting the security if it is a private document, the copy if it is a notarised document, the court decision or a copy of these documents. For the vendor’s lien on a business, the document to be submitted must be the original of the deed of transfer of the business if it is a private document or a copy of it if it is a notarised document.

The previous paragraph is not applicable to the vendor’s lien on a business.
The previous paragraph does not apply to debt declarations in the event of the business being transferred to a company, nor to Treasury and social security liens, nor to leasing transactions involving movable property, nor to the contracts mentioned in article L. 624-10.

Le requérant joint au bordereau, selon le cas, l’original de l’acte constitutif de la sûreté s’il est sous seing privé, l’expédition s’il est authentique, la décision de justice ou la copie de ces justificatifs. Pour le privilège du vendeur de fonds commerce, l’acte à remettre doit être l’original de l’acte de cession du fonds de commerce s’il est sous seing privé ou l’expédition s’il est authentique.


L’alinéa précédent n’est pas applicable aux déclarations de créance en cas d’apport du fonds de commerce à une société, ni aux privilèges du Trésor et de la sécurité sociale ni aux opérations de crédit-bail en matière mobilière, ni aux contrats mentionnés à l’article L. 624-10.
