Article R5215-16 of the French General Code of Local Authorities

In the event that an expropriation procedure has been initiated for the benefit of a commune with a view to carrying out an operation transferred to the urban community, the procedure is continued for the benefit of the latter, which is substituted for the commune in all related acts.

The procedure is considered to be initiated, within the meaning of the preceding paragraph, on the date of the prefectoral order relating to the enquiry prior to the declaration of public utility, referred to in article R. 112-12 of the code de l’expropriation pour cause d’utilité publique.

Article R5215-16

Dans le cas où une procédure d’expropriation a été engagée au bénéfice d’une commune en vue de la réalisation d’une opération transférée à la communauté urbaine, la procédure est poursuivie au bénéfice de cette dernière, qui se trouve substituée à la commune dans tous les actes y afférents.

La procédure est considérée comme engagée, au sens de l’alinéa qui précède, à la date de l’arrêté préfectoral relatif à l’enquête préalable à la déclaration d’utilité publique, mentionné à l’article R. 112-12 du code de l’expropriation pour cause d’utilité publique.
