Article R53-8-64 of the French Code of Criminal Procedure

Persons detained in the centres come under the jurisdiction of a vice-president responsible for the enforcement of sentences of one of the judicial courts of the court of appeal, appointed by the first president of this court.

This magistrate is responsible for monitoring, for each person detained, the main procedures for implementing secure detention and the smooth running of the measure.

He may have any examinations, hearings, investigations, expert reports, requisitions or verifications carried out throughout France that are useful for the exercise of his or her powers.

It visits the centres under its jurisdiction at least once a month and checks with each person detained the conditions in which they are being held.

The first president of the court of appeal may appoint one or more substitute judges from among the vice-presidents responsible for the enforcement of sentences in the judicial courts within its jurisdiction.

Les personnes retenues dans les centres relèvent de la compétence d’un vice-président chargé de l’application des peines de l’un des tribunaux judiciaires de la cour d’appel, désigné par le premier président de cette cour.


Ce magistrat est chargé de contrôler, pour chaque personne retenue, les principales modalités de mise en œuvre de la rétention de sûreté et le bon déroulement de la mesure.


Il peut faire procéder, sur l’ensemble du territoire national, à tous examens, auditions, enquêtes, expertises, réquisitions ou vérifications utiles à l’exercice de ses attributions.


Il visite les centres relevant de sa compétence au moins une fois par mois et vérifie auprès de chaque personne retenue les conditions dans lesquelles se déroule sa rétention.


Le premier président de la cour d’appel peut désigner un ou plusieurs magistrats suppléants parmi les vice-présidents chargés de l’application des peines des tribunaux judiciaires de son ressort.
