Article R541-2 of the French Consumer Code

For the application of article R. 541-1 in New Caledonia:

1° A l’article R. 512-16-7, the words: “, without prejudice to the penalty provided for in Article L. 531-6” are deleted;

2° In Article R. 512-17, the references: “R. 512-18 to R. 512-24” are replaced by the references: “R. 512-18 to R. 512-21 and R. 512-23”;

3° In Article R. 512-30, the words: “to the provisions set out in Articles L. 121-2 to L. 121-4 and Book IV of the legislative part of this Code as well as the provisions adopted for its application” are replaced by the words: “with regard to fraud prevention”;

4° In Article R. 512-35, the words: “in Article 11 of Regulation (EC) No 882/2004 of the European Parliament and of the Council of 29 April 2004 as amended on official controls performed to ensure the verification of compliance with feed and food law, animal health and animal welfare rules” are replaced by the words: “in European Union regulations or, failing that, by internationally recognised rules or protocols, in particular by the European Committee for Standardisation or those adopted in the legislation applicable in mainland France or, failing that, other methods appropriate in view of the objective pursued or developed in accordance with scientific protocols, or methods of analysis validated within a single laboratory in accordance with an internationally accepted protocol”;

5° In all occurrences of the expression: “State laboratory” or “State laboratories”, the words: “d’Etat” are deleted.

Pour l’application de l’article R. 541-1 en Nouvelle-Calédonie :

3° A l’article R. 512-30, les mots : “ aux dispositions prévues à l’article L. 121-2 à L. 121-4 et au livre IV de la partie législative du présent code ainsi qu’aux dispositions prises pour son application ” sont remplacés par les mots : “ en matière de répression des fraudes ” ;

4° A l’article R. 512-35, les mots : “ à l’article 11 du règlement (CE) n° 882/2004 du Parlement européen et du Conseil du 29 avril 2004 modifié relatif aux contrôles officiels effectués pour s’assurer de la conformité avec la législation sur les aliments pour animaux et les denrées alimentaires et avec les dispositions relatives à la santé animale et au bien-être des animaux ” sont remplacés par les mots : “ dans la réglementation de l’Union européenne ou à défaut, par des règles ou des protocoles reconnus sur le plan international, notamment par le Comité européen de normalisation ou ceux qui ont été adoptés dans la législation applicable en métropole ou, à défaut, d’autres méthodes appropriées au vu de l’objectif poursuivi ou élaborées conformément à des protocoles scientifiques, ou des méthodes d’analyse validées au sein d’un seul laboratoire suivant un protocole accepté sur le plan international ” ;

5° Dans toutes les occurrences de l’expression : “ laboratoire d’Etat ” ou “ laboratoires d’Etat ”, les mots : “ d’Etat ” sont supprimés.
