Article R5412-6 of the French Labour Code

When the striking off is pronounced in application of the provisions of article R. 5412-4, its duration is equal to the duration of the withdrawal of the replacement income.

In the event of permanent withdrawal of replacement income, the duration of the striking off is between six and twelve consecutive months. However, when the definitive withdrawal concerns a breach linked to an undeclared activity of very short duration, the period of withdrawal is six months.

Lorsque la radiation est prononcée en application des dispositions de l’article R. 5412-4, sa durée est égale à la durée de la suppression du revenu de remplacement.

En cas de suppression définitive du revenu de remplacement, la durée de la radiation est comprise entre six et douze mois consécutifs. Toutefois, lorsque la suppression définitive concerne un manquement lié à une activité non déclarée d’une durée très brève, la durée de la radiation est de six mois.
