Article R5422-2-2 of the French Labour Code

The regional cross-industry joint committee will notify the employee of its decision by any means that provides a definite date for receipt of this notification and will inform the employee, where applicable, of the reasons for the refusal to certify the genuine and serious nature of his or her career plan. It also informs the employee of the possibility of lodging an informal appeal against this decision, within two months of its notification. This appeal is examined under the conditions set out in the second paragraph of article R. 6323-16.

The employee is notified of the decision taken on the informal appeal by any means giving a certain date to the receipt of this notification. In the event of confirmation of the refusal to attest to the real and serious nature of the professional project, reasons are given.

La commission paritaire interprofessionnelle régionale notifie sa décision au salarié par tout moyen donnant date certaine à la réception de cette notification et l’informe, le cas échéant, des raisons motivant le refus d’attester du caractère réel et sérieux de son projet professionnel. Elle l’informe également de la possibilité d’exercer un recours gracieux contre cette décision, dans un délai de deux mois à compter de sa notification. Ce recours est examiné dans les conditions fixées au deuxième alinéa de l’article R. 6323-16.


La décision prise sur le recours gracieux est notifiée au salarié par tout moyen donnant date certaine à la réception de cette notification. En cas de confirmation du refus d’attester du caractère réel et sérieux du projet professionnel, elle est motivée.
