For the application of the first paragraph of article L. 552-15, if a person remains in the accommodation after the date mentioned in article R. 552-12 or, where applicable, after the expiry of the period stipulated in article R. 552-13, the Prefect of the département in which the accommodation is located or the manager of the accommodation shall give the person concerned formal notice to leave the premises in the following cases:
1° The person does not have a residence permit and has not applied for assisted voluntary return or has refused the offer of assisted voluntary return made to them by the French Office for Immigration and Integration;
2° The person has a residence permit in France and has refused one or more offers of housing or accommodation made to them with a view to vacating the accommodation occupied.
If the formal notice is unsuccessful, the prefect or the manager of the accommodation may, after a final rejection decision and under the conditions set out in article L. 552-15, refer the matter to the president of the administrative court in order to enjoin the occupant to leave the premises.
