Article R581-10 of the French Code governing the entry and residence of foreign nationals and the right of asylum

When a beneficiary of temporary protection in another Member State of the European Union applies to be transferred to France, the Minister responsible for immigration, to whom the application has been referred by the competent authorities of the Member State in which the person concerned is resident, shall decide on the application, taking account in particular of reception capacity.

Lorsqu’un bénéficiaire de la protection temporaire dans un autre Etat membre de l’Union européenne sollicite son transfert vers la France, le ministre chargé de l’immigration, saisi de cette demande par les autorités compétentes de l’Etat membre dans lequel l’intéressé a sa résidence, statue sur cette demande en tenant compte notamment des capacités d’accueil.
