Article R612-14 of the French Intellectual Property Code

In the case provided for in Article L. 612-5, second paragraph, the culture shall be deposited no later than the filing date of the patent application and the description shall specify:

1° The information available to the applicant on the characteristics of the micro-organism;

2° The authorised body with which the culture was deposited and the deposit number.

The indications provided for in 2° of the preceding paragraph may be provided either within a period of sixteen months from the filing date or the earliest date from which the patent application benefits or, if priority has been claimed, from the priority date, or at the time of the request provided for in Article L. 612-21, if this request is submitted before the expiry of this period. Their communication implies, on the part of the applicant, irrevocable and unconditional consent to make the culture available to the public in accordance with the provisions of articles R. 612-42 and R. 612-43.

Article R612-14

Dans le cas prévu à l’article L. 612-5, deuxième alinéa, la culture est déposée au plus tard à la date de dépôt de la demande de brevet et la description précise :

1° Les informations dont dispose le demandeur sur les caractéristiques du micro-organisme ;

2° L’organisme habilité auprès duquel le dépôt de la culture a été effectué ainsi que le numéro du dépôt.

Les indications prévues au 2° de l’alinéa précédent peuvent être fournies soit dans un délai de seize mois à compter de la date de dépôt ou de la date la plus ancienne dont bénéficie la demande de brevet ou, si une priorité a été revendiquée, de la date de priorité, soit lors de la requête prévue à l’article L. 612-21, si cette requête est présentée avant l’expiration de ce délai. Leur communication emporte, de la part du demandeur, consentement irrévocable et sans réserve de mettre la culture à la disposition du public conformément aux dispositions des articles R. 612-42 et R. 612-43.
