1. If it is found that parts of the description, or drawings referred to in the description or claims, do not appear to be included in the application, the applicant shall be invited to produce the missing parts within two months.
2. If the missing parts of the description or the missing drawings are submitted within the period of two months after the filing date or, where an invitation is issued in accordance with paragraph 1, within the period of two months from that invitation, the applicant shall be informed that the filing date of the application shall be the date on which the missing parts of the description or the missing drawings were filed, unless the missing parts of the description or the missing drawings are withdrawn within a period of one month from the date of their filing.
3. If the missing parts of the description or the missing drawings are submitted within the period provided for in 2°, and if the application claims the priority of an earlier application, the filing date shall remain the date on which the requirements of Article L. 612-2, provided that the missing parts of the description or the missing drawings appear in full in the earlier application and that, within the time limit laid down in 2°, the applicant so requests and produces a copy of the earlier application, unless such a copy is available to the National Institute of Industrial Property, and, where appropriate, a translation into French. The applicant must then indicate where the missing parts of the description or the missing drawings appear in full in the earlier application and, where applicable, in the translation thereof.
4. If the applicant does not file the missing parts of the description or the missing drawings within the time limits provided for in 1° and 2°, any reference made to those parts of the description or those drawings shall be deleted.
Where applicable, the new filing date will be notified to the applicant.
