Article R6121-7 of the French Labour Code

I.-The accreditation agreement contains the information set out in 1° to 11° of article R. 6121-3 and mentions the rights and commitments of the chosen organisation.

It is signed by the successful applicant and then by the President of the Regional Council. The successful candidate is then notified so that it can be implemented.

II -Where the financial compensation is equal to or greater than the threshold for the formalised procedure applicable to other contracting authorities, mentioned in appendix no. 2 of the Public Procurement Code, the authorisation agreement is the subject of an award notice sent to the Office for Official Publications of the European Union.

III – No later than six months before the expiry of the authorisation agreement, the signatory organisation provides the region with information enabling it to assess quantitatively and qualitatively the fulfilment of the public service mission it is carrying out, with regard to the objectives of the latter and the indicators mentioned in 10° of article R. 6121-3.

I.-La convention d’habilitation contient les informations figurant aux 1° à 11° de l’article R. 6121-3 et mentionne les droits et les engagements de l’organisme retenu.

Elle est signée par celui-ci puis par le président du conseil régional. Sa notification au candidat retenu permet son exécution.

II.-Lorsque la compensation financière est d’un montant égal ou supérieur au seuil de procédure formalisée applicable aux autres pouvoirs adjudicateurs, mentionné à l’annexe n° 2 du code de la commande publique, la convention d’habilitation fait l’objet d’un avis d’attribution transmis à l’office des publications officielles de l’Union européenne.

III.-Au plus tard six mois avant l’échéance de la convention d’habilitation, l’organisme signataire fournit à la région les éléments lui permettant d’évaluer quantitativement et qualitativement la réalisation de la mission de service public qu’il assure, au regard des objectifs de celle-ci et des indicateurs mentionnés au 10° de l’article R. 6121-3.
