Article R6123-100-1 of the French Public Health Code

Without prejudice to compliance with the provisions of Article R. 6123-98, holders of authorisation for cancer treatment by radiotherapy are not subject to the conditions of thresholds provided for in Article R. 6123-91-4, holders of authorisation for neurosurgery with the practice of intracranial and extracranial radiosurgery in stereotactic conditions, provided that they do not provide other techniques relating to radiotherapy subject to authorisation under 2° of article R. 6123-86-1.

However, the provisions of articles R. 6123-93, R. 6123-93-3 and II of article R. 6123-93-4 are applicable to them.

The operating theatre may be used as a radiotherapy unit as referred to in 1° of article R. 6123-93-3.

Article R6123-100-1

Sans préjudice du respect des dispositions de l’article R. 6123-98, ne sont pas soumis à l’autorisation de traitement du cancer par radiothérapie, ni aux conditions de seuils prévues par l’article R. 6123-91-4, les titulaires d’autorisation de neurochirurgie avec la pratique de radiochirurgie intracrânienne et extracrânienne en condition stéréotaxique, dès lors qu’ils ne dispensent pas d’autres techniques relevant de la radiothérapie soumise à autorisation au titre du 2° de l’article R. 6123-86-1.

Toutefois, les dispositions des articles R. 6123-93, R. 6123-93-3, du II de l’article R. 6123-93-4 leur sont rendues opposables.

Le secteur opératoire peut être utilisé en tant qu’unité de radiothérapie mentionnée au 1° de l’article R. 6123-93-3.
