Article R6123-109-4 of the French Public Health Code

The holder of the authorisation ensures that patients are diagnosed and treated on a permanent basis, in liaison with the emergency medicine structures mentioned in article R. 6123-1, including via telehealth.

This round-the-clock service may be shared by several authorised sites. In this case, an agreement is drawn up between the authorisation holders for each site.

When the duty of care is provided for several sites, the agreement referred to in the 2nd paragraph specifies in particular the methods of organisation between the sites, the participation of the staff of each site and the methods of referral and management of patients.

Le titulaire de l’autorisation assure en permanence, en liaison avec les structures de médecine d’urgence mentionnées à l’article R. 6123-1, le diagnostic, y compris par télésanté, et le traitement des patients.


Cette permanence peut être commune à plusieurs sites autorisés. Dans ce cas, une convention est établie entre les titulaires d’autorisation propre à chaque site.


Lorsque la permanence des soins est assurée pour plusieurs sites, la convention mentionnée au 2ème alinéa précise notamment les modalités d’organisation entre les sites, de participation des personnels de chaque site et les modalités d’orientation et de prise en charge des patients.
