The provisions of this section do not prevent a health care establishment which is not authorised to carry out the activity mentioned in 3° of article R. 6123-1 from fulfilling its general obligations to assist and care for persons in danger who come to it and :
1° Provides immediate care to a patient who presents himself during the opening hours of his consultations and, if necessary, refers him or has him transferred, after regulation by the SAMU, to a health establishment authorised to carry out this activity;
2° Providing unscheduled care to any patient referred to it by a private practitioner, after examination and consent of the patient, when direct prior agreement has been given by the establishment’s doctor who will be called upon to provide the necessary care;
3° Provides unscheduled care to any patient referred to it by the SAMU (emergency medical service) when prior agreement has been given for the patient to be admitted to the establishment.
