Article R6123-141 of the French Public Health Code

I.-The home hospital care authorisation includes one or more of the following references:

1° “base”;

2° “rehabilitation”;

3° “ante- and post-partum”;

4° “children under the age of three”.

A home hospitalisation authorisation containing one of the terms provided for in 2°, 3° or 4° may only be granted if the holder has a home hospitalisation authorisation containing the term “base” or obtains such an authorisation at the same time.

II.-Only holders of a “children under three years of age” authorisation are authorised to provide care for children under three years of age, subject to the provisions of 1° and 2° below:

1° Children requiring palliative or end-of-life care may be cared for by facilities holding a “basic” authorisation only. For this type of care, the holder of the home hospital care authorisation with the “base” designation will seek the expertise of a home hospital care facility holding an authorisation with the “children under three” designation or of a regional palliative care resource team;

2° Newborn babies whose mother is receiving post-partum care from a facility holding a home hospital care authorisation with the “ante and post-partum” mention may be cared for within the same facility.

I.-L’autorisation d’activité de soins d’hospitalisation à domicile comporte une ou plusieurs des mentions suivantes :

1° Mention “ socle ” ;

2° Mention “ réadaptation ” ;

3° Mention “ ante et post-partum ” ;

4° Mention “ enfants de moins de trois ans ”.

L’autorisation d’hospitalisation à domicile comportant l’une des mentions prévues aux 2°, 3° ou 4° ne peut être accordée que si le titulaire dispose d’une autorisation d’hospitalisation à domicile comportant la mention “ socle ” ou obtient concomitamment une telle autorisation.

II.-Seuls les titulaires d’une autorisation comportant la mention “ enfants de moins de trois ans ” sont autorisés à prendre en charge les enfants de moins de trois ans, sous réserve des dispositions des 1° et 2° qui suivent :

1° Les enfants relevant d’une prise en charge en soins palliatifs ou fin de vie peuvent être pris en charge par des structures titulaires d’une autorisation comportant uniquement la mention “ socle ”. Pour une telle prise en charge, le titulaire de l’autorisation d’hospitalisation à domicile comportant la mention “ socle ” sollicite l’expertise d’une structure d’hospitalisation à domicile titulaire d’une autorisation comportant la mention “ enfants de moins de trois ans ” ou d’une équipe régionale ressource de soins palliatifs ;

2° Les nouveau-nés dont la mère est prise en charge en post-partum par une structure titulaire de l’autorisation d’hospitalisation à domicile comportant la mention “ ante et post-partum peuvent être pris en charge au sein de la même structure.
