Article R6123-203 of the French Public Health Code

I.-Authorisation is granted to applicants who provide:

1° Both outpatient surgical care and full-time inpatient surgical care;

2° Or outpatient surgical care only. In this case, the holder enters into an agreement with a health establishment that provides full-time inpatient surgical care and allows this care to be provided within a timeframe that is compatible with the imperatives of care safety.

II – By way of derogation from I of the present article, authorisation may be granted to an applicant whose site offers only full-time hospitalisation, provided either that he holds another surgical authorisation offering outpatient surgery on a nearby site, or that he enters into an agreement with another holder offering outpatient surgery on the same site or, failing that, on a nearby site.

Article R6123-203

I.-L’autorisation est accordée au demandeur qui assure :

1° Soit à la fois une prise en charge de chirurgie ambulatoire et une prise en charge chirurgicale en hospitalisation à temps complet ;

2° Soit la seule prise en charge en chirurgie ambulatoire. Dans ce cas, le titulaire conclut une convention avec un établissement de santé réalisant une prise en charge chirurgicale en hospitalisation à temps complet et permettant cette prise en charge dans des délais compatibles avec les impératifs de sécurité des soins.

II.-Par dérogation au I du présent article, l’autorisation peut être accordée à un demandeur disposant sur son site de la seule forme d’hospitalisation à temps complet, à condition soit qu’il détienne une autre autorisation de chirurgie proposant la chirurgie ambulatoire sur un site à proximité, soit qu’il conclue une convention avec un autre titulaire proposant la chirurgie ambulatoire situé sur le même site ou, à défaut, sur un site à proximité.
