Article R6123-33 of the French Labour Code

France Compétences allocates the additional funds mentioned in Article R. 6123-31 to the skills operators in accordance with activity forecasts showing a shortfall in coverage.

The activity forecasts detail the need for new and existing commitments.

The allocation takes into account the average cancellation of commitments over the last four years in the case of apprenticeship contracts and the last three years in the case of vocational training contracts and retraining or work-linked training schemes. It excludes from the coverage requirement old commitments of more than four years for apprenticeship contracts and more than three years for vocational training contracts and retraining or promotion through work-study schemes.

Pour l’accomplissement de la mission de péréquation, France compétences attribue aux opérateurs de compétences la dotation complémentaire mentionnée à l’article R. 6123-31 en fonction de prévisions d’activité démontrant une insuffisance de couverture.

Les prévisions d’activité détaillent les besoins d’engagements nouveaux et anciens.

La dotation tient compte de la moyenne d’annulation des engagements constatés au cours des quatre dernières années pour les contrats d’apprentissage et des trois dernières années pour les contrats de professionnalisation et les reconversions ou promotions par alternance. Elle exclut du besoin de couverture les engagements anciens de plus de quatre ans pour les contrats d’apprentissage et de plus de trois ans pour les contrats de professionnalisation et les reconversions ou promotions par alternance.
