I. – The holder of the 1° designation and the 2° designation under the paediatric critical care modality of article R. 6123-34-2 must comply with a minimum annual activity level set by order of the Minister for Health.
In the case of a new establishment, the minimum annual activity level is forecast for the first year.
This activity level is expressed in terms of the number of infants, children and adolescents under the age of 18 cared for, excluding newborns in neonatal intensive care.
II. – In the event of an exceptional and temporary event leading to a significant drop in activity, the Director General of the Regional Health Agency, at the express request of the licensee, may suspend the application of I of this article for a maximum period of one year, provided that the licensee has made commitments to resolve the said event.
III – In accordance with article L. 6122-2, an authorisation derogating from I of this article may be granted, maintained or renewed on an exceptional basis when, after analysing the needs of the population, access to other sites practising these mentions imposes excessive journey times on a significant proportion of the population of the health territory.
