Article R6123-52 of the French Public Health Code

When an establishment that does not have the three units mentioned in article R. 6123-39 does not join a specific regional scheme, the Director General of the Regional Health Agency invites the establishment to enter into an agreement with one or more health establishments that have the units it does not have, in order to ensure the referral of pregnant women, to organise transfers, possibly in an emergency, of mothers and newborns between these establishments and to specify the transmission of information.

These agreements are drawn up and signed by the representatives of the establishments after obtaining the opinion of the representative bodies mentioned in articles L. 6144-1 and L. 6144-3, after obtaining the opinion of the medical commission provided for in article L. 6161-8 or the opinion of the medical conference provided for in article L. 6161-2. They are submitted to the Director General of the Regional Health Agency for approval and do not come into force until this approval has been given.

Lorsqu’un établissement ne disposant pas des trois unités mentionnées à l’article R. 6123-39 n’adhère pas à un dispositif spécifique régional, le directeur général de l’agence régionale de santé invite l’établissement à passer convention avec un ou plusieurs établissements de santé possédant les unités dont il ne dispose pas, afin d’assurer l’orientation des femmes enceintes, d’organiser les transferts, éventuellement en urgence, des mères et des nouveau-nés entre ces établissements et de préciser les transmissions d’informations.

Ces conventions sont établies et signées par les représentants des établissements après avis des organes représentatifs mentionnés aux articles L. 6144-1 et L. 6144-3, après avis de la commission médicale prévue à l’article L. 6161-8 ou avis de la conférence médicale prévue à l’article L. 6161-2. Elles sont soumises à l’approbation du directeur général de l’agence régionale de santé et n’entrent en vigueur qu’après cette approbation.
