Article R6123-83-5 of the French Public Health Code

The application for authorisation is sent to the Director General of the Regional Health Agency, by any means which provides a date certain of its receipt, by the health establishment seeking authorisation.

The composition of the application is defined by an order of the Ministers responsible for health and social security.

The Regional Health Agency sends the application, within a maximum of one month of its receipt, by electronic means, to the secretariat of the national committee provided for in article L. 162-30-5 of the Social Security Code and, where appropriate, sends its opinion on the application with it.

The authorisation is granted for a period of five years by the Director General of the Regional Health Agency, after receiving the assent of the national committee referred to in Article R. 6123-84 of this Code.

Reasons are given for the authorisation and notification is given within one month of the opinion referred to in the previous paragraph being issued. It is published in the Journal officiel de la République française.

In the absence of notification of an authorisation decision within six months of receipt of the application by the Director General of the Regional Health Agency, the application is rejected.

La demande d’autorisation est adressée au directeur général de l’agence régionale de santé, par tout moyen donnant date certaine à sa réception, par l’établissement de santé qui sollicite la délivrance de l’autorisation.

La composition du dossier est définie par un arrêté des ministres chargés de la santé et de la sécurité sociale.

L’agence régionale de santé transmet la demande, dans un délai maximum d’un mois après sa réception, par voie électronique, au secrétariat du comité national prévu à l’article L. 162-30-5 du code la sécurité sociale et accompagne, le cas échéant, cet envoi de son avis sur la demande.

L’autorisation est délivrée pour une durée de cinq ans par le directeur général de l’agence régionale de santé, après avis conforme du comité national mentionné à l’article R. 6123-84 du présent code.

Elle est motivée et notifiée dans un délai d’un mois après l’émission de l’avis prévu à l’alinéa précédent. Elle est publiée au Journal officiel de la République française.

A défaut de notification d’une décision d’autorisation dans un délai de six mois à compter de la réception de la demande par le directeur général de l’agence régionale de santé, la demande est rejetée.
