Article R6123-84-2 of the French Public Health Code

The national committee rules on authorisation to carry out exceptional transplants and issues the opinion provided for in the first paragraph of I of article L. 162-30-5 of the Social Security Code. It issues an opinion for each graft on the amount of reimbursement and related hospitalisation costs, and the duration and conditions of reimbursement by the health insurance scheme of the lump sum referred to in II of the same article, within four months of the initial receipt of the application by the Committee secretariat.

The Chairman of the National Committee appoints as rapporteurs, on the proposal of the Director General of the Agence de la biomédecine, at least two experts from the learned societies of the medical specialities concerned. Each rapporteur submits to the Chairman of the National Committee the declaration of links of interest provided for in Article L. 1451-1 of this Code and undertakes to respect the confidentiality of the discussions.

Each rapporteur draws up and submits his report to the Committee within a maximum of two months of his appointment and is heard during the deliberations.

When the Chairman of the National Committee deems it useful, a representative of the requesting establishment may be heard at the meeting.

Le comité national statue sur l’autorisation de pratiquer la greffe exceptionnelle et émet l’avis prévu au premier alinéa du I de l’article L. 162-30-5 du code de la sécurité sociale. Il rend un avis pour chaque greffe sur le montant de la prise en charge et des frais d’hospitalisation y afférents, la durée et les conditions de la prise en charge par l’assurance maladie du forfait mentionné au II du même article, dans un délai de quatre mois après la réception initiale du dossier par le secrétariat du comité.

Le président du comité national désigne en qualité de rapporteurs, sur proposition du directeur général de l’Agence de la biomédecine, au moins deux experts issus des sociétés savantes des spécialités médicales concernées. Chaque rapporteur adresse au président du comité national la déclaration des liens d’intérêts prévue à l’article L. 1451-1 du présent code et s’engage au respect de la confidentialité des débats.

Chaque rapporteur établit et adresse son rapport au comité dans un délai maximum de deux mois à compter de sa désignation et est entendu lors des délibérations.

Lorsque le président du comité national le juge utile, un représentant de l’établissement demandeur peut être entendu en séance.
