Article R6123-91-10 of the French Public Health Code

I.-The authorisation may only be granted if the applicant has an organisation, set up where appropriate jointly with other cancer treatment authorisation holders, which ensures that each patient is treated throughout the course of the disease and in accordance with the best practice guidelines defined by the Institut national du cancer in application of 2° of article L. 1415-2 :

1° Assessment of patients’ needs and access to the necessary supportive oncology care, including pain management, psychological support, improved access to social services and, where appropriate, the palliative approach ;

2° Where appropriate, support and referral of patients as close as possible to their place of life to the local support care available in hospitals, outpatient clinics or associations, concerning, in addition to the support care mentioned in 1°, that mentioned in the aforementioned good practice guidelines defined by the Institut National du Cancer in application of 2° of article L. 1415-2.

II.-The organisation referred to in I enables:

1° Patients to be systematically informed about national addiction information systems, in particular those relating to tobacco and alcohol, and, if necessary, to be referred to an addiction consultation in a health establishment, a general practitioner or other suitable structure;

2° If necessary, patients to be referred to the regional centres for occupational or environmental pathologies provided for in article R. 1339-1;

3° Encouraging psychological support for carers or those close to the patient.

I.-L’autorisation ne peut être accordée que si le demandeur dispose d’une organisation, mise en place le cas échéant conjointement avec d’autres titulaires d’une autorisation de traitement du cancer, qui assure à chaque patient tout au long de la maladie et conformément au référentiel de bonnes pratiques défini par l’Institut national du cancer en application du 2° de l’article L. 1415-2 :

1° L’évaluation des besoins et l’accès aux soins oncologiques de support nécessaires aux patients, notamment la prise en charge de la douleur, le soutien psychologique, le renforcement de l’accès aux services sociaux et, s’il y a lieu, la démarche palliative ;

2° Le cas échéant, l’accompagnement et l’orientation du patient au plus près de son lieu de vie auprès de l’offre territoriale de soins de support en milieu hospitalier, en médecine de ville ou en milieu associatif, concernant, outre les soins de support mentionnés au 1°, ceux mentionnés dans le référentiel de bonnes pratiques précité défini par l’institut national du cancer en application du 2° de l’article L. 1415-2.

II.-L’organisation mentionnée au I permet :

1° L’information systématique du patient sur les dispositifs nationaux d’information sur les addictions, notamment celles liées au tabac et à l’alcool, et, s’il y a lieu, de favoriser son orientation vers une consultation d’addictions en établissement de santé, en médecine de ville ou dans d’autres structures adaptées ;

2° Le cas échéant, l’orientation des patients vers les centres régionaux de pathologies professionnelles ou environnementales prévus à l’article R. 1339-1 ;

3° De favoriser le soutien psychologique des aidants ou des proches du patient.
