I.- By way of derogation from the provisions of article R. 6123-87-1, a holder of a surgical oncology authorisation who has rare specific equipment included on a list drawn up by order of the Minister for Health may receive on its site members of a surgical team from another site authorised in the same region for one or more of the surgical oncology indications in order to benefit from the use of this rare specific equipment.
II.-The establishment hosting the surgical team must hold an authorisation for the oncological surgery performed. The establishment which has the rare specific equipment on its site may not hold authorisation for the oncology surgery performed, but must meet the requirements in terms of technical facilities and critical care set for the oncology surgical practice concerned.
The oncology surgical activity concerned is counted as part of the oncology surgical activity of the establishment of the surgical team hosting the operation.
III.-This dispensatory surgical oncology practice is subject to the condition of a written commitment, by means of an agreement between the two holders of the authorisation for surgical oncology with mention A or by a formalised organisation in the case of the same legal entity.
The draft agreement or the draft formalised organisation is sent by the holder of the surgical oncology authorisation with the rare specific equipment on its site to the competent regional health agency.
