Article R6123-92-8 of the French Public Health Code

The surgical oncological management of a patient suffering from a rare cancer is carried out within an establishment holding an authorisation to carry out the activity of cancer treatment by surgical oncology which has on its site a centre of reference or a centre of competence for rare cancers labelled by the Institut national du cancer.

By way of derogation from the previous paragraph, this surgical management may be carried out within another cancer treatment centre using surgical oncology, without prejudice to compliance with the provisions of article R. 6123-87-1 and subject only to the following conditions:

1° The multidisciplinary consultation on the rare cancer referred to in II of article R. 6123.91-2 has proposed this;

2° The analysis of the surgical specimen after surgery must be carried out by the centre of reference or competence for the rare disease concerned or its rare cancer anatomopathology network.

La prise en charge chirurgicale oncologique d’un patient atteint d’un cancer rare est réalisée au sein d’un établissement titulaire d’autorisation d’exercer l’activité de traitement du cancer par chirurgie oncologique disposant sur son site d’un centre de référence ou d’un centre de compétences cancers rares labellisé par l’Institut national du cancer.

Par dérogation au précédent alinéa, cette prise en charge chirurgicale peut être réalisée au sein d’un autre titulaire de traitement du cancer par chirurgie oncologique, sans préjudice du respect des dispositions de l’article R. 6123-87-1 et aux seules conditions suivantes :

1° La concertation pluridisciplinaire de recours sur le cancer rare mentionnée au II de l’article R. 6123.91-2 l’a proposé ;

2° L’analyse de la pièce opératoire après intervention chirurgicale est obligatoirement réalisée par le centre de référence ou de compétences de la maladie rare concernée ou son réseau d’anatomopathologie de cancer rare.
