The surgical oncological management of a patient suffering from a rare cancer is carried out within an establishment holding an authorisation to carry out the activity of cancer treatment by surgical oncology which has on its site a centre of reference or a centre of competence for rare cancers labelled by the Institut national du cancer.
By way of derogation from the previous paragraph, this surgical management may be carried out within another cancer treatment centre using surgical oncology, without prejudice to compliance with the provisions of article R. 6123-87-1 and subject only to the following conditions:
1° The multidisciplinary consultation on the rare cancer referred to in II of article R. 6123.91-2 has proposed this;
2° The analysis of the surgical specimen after surgery must be carried out by the centre of reference or competence for the rare disease concerned or its rare cancer anatomopathology network.
