Article R6123-93-1 of the French Public Health Code

When the applicant for an authorisation including the mention of external radiotherapy and brachytherapy provided for in 2° of article R. 6123-86-1 is not a health establishment, this authorisation may only be issued or renewed if the facilities it uses to carry out its activity are located within the enclosure or in neighbouring buildings of a health establishment holding the authorisation provided for in article R. 6123-86.

The authorisation is subject to the conclusion of an agreement organising their cooperation in cancerology for the care of the patients they receive, for each type of practice for which they are authorised.

Article R6123-93-1

Lorsque le demandeur d’une autorisation comportant la mention de radiothérapie externe et curiethérapie prévue au 2° de l’article R. 6123-86-1 n’est pas un établissement de santé, cette autorisation ne peut être délivrée ou renouvelée que si les installations dont il dispose pour exercer son activité sont situées dans l’enceinte ou dans des bâtiments voisins d’un établissement de santé détenant l’autorisation prévue à l’article R. 6123-86.

L’autorisation est subordonnée à la conclusion d’une convention organisant leur coopération en cancérologie pour la prise en charge des patients qu’ils reçoivent, au titre de chaque modalité d’exercice pour lesquelles ils sont autorisés.
