Article R6123-93-2 of the French Public Health Code

I.- Authorisation to carry out the activity of cancer treatment by external radiotherapy may only be granted or renewed to an applicant who has a technical platform comprising at least two particle accelerators on the same site.

II.- Authorisation may exceptionally be granted to an applicant who has only one particle accelerator.However, by way of exception, authorisation may be granted to an applicant who has only one particle accelerator, where access to a technical platform imposes excessive journey times or waiting times on a significant proportion of the population in the health region.

However, this exceptional authorisation may only be granted to an applicant who has the technical platform provided for in the first paragraph on another site in the same region or in an adjacent region.

The provisions relating to the minimum activity threshold applicable to holders of authorisation to carry out the activity of cancer treatment by radiotherapy in application of article R. 6123-91-4 do not apply to derogatory radiotherapy sites for geographical exception.

I.-L’autorisation de mettre en œuvre l’activité de traitement du cancer par radiothérapie externe ne peut être délivrée ou renouvelée qu’à un demandeur qui dispose d’un plateau technique comprenant sur le même site au moins deux accélérateurs de particules.

II.-Toutefois, elle peut exceptionnellement être accordée à titre dérogatoire à un demandeur qui dispose d’un seul accélérateur de particules, lorsque l’accès à un plateau technique impose des temps de trajet ou des délais d’attente excessifs à une partie significative de la population du territoire de santé.

Cette autorisation dérogatoire ne peut cependant être accordée qu’à un demandeur qui dispose sur un autre site, dans la même région ou dans une région limitrophe, du plateau technique prévu au premier alinéa.

Les dispositions relatives au seuil d’activité minimale opposable aux titulaires d’autorisation d’exercer l’activité de soins de traitement du cancer par radiothérapie en application de l’article R. 6123-91-4 ne sont pas applicables aux site dérogatoires de radiothérapie pour exception géographique.
