Article R6142-18 of the French Public Health Code

In the event of an infringement of the regulations by a member of staff working for the university hospital centre, the university or a training or research unit, the penalty shall be imposed by the disciplinary authority, at the request of the person responsible for applying the regulations. In urgent cases, the latter may request the suspension of the offender.

Exceptionally and in serious cases, the director of a training and research unit may temporarily ban a member of the university hospital centre’s staff from the university premises. The director general of the university hospital centre may, under the same conditions, prohibit access to the grounds and hospital buildings or services by a member of staff of the university or of a training and research unit. The authority that has taken the measure shall immediately notify the authority normally responsible, with a view to a joint examination of the situation.

If the breach of the regulations has been committed by a student, the person responsible for applying the regulations will refer the matter to the director of the training and research unit concerned.

Exceptionally and in serious cases, the Director General of the university hospital centre may temporarily ban the offender from the grounds and hospital buildings or services. The director of the training and research unit concerned will be informed immediately so that the situation can be examined jointly.

En cas d’infraction au règlement par un agent relevant soit du centre hospitalier universitaire, soit de l’université soit d’une unité de formation ou de recherche, la sanction est prononcée par l’autorité investie du pouvoir disciplinaire, saisie à la demande du responsable de l’application du règlement. En cas d’urgence, celui-ci peut demander la suspension du fautif.

Exceptionnellement et dans les cas graves, le directeur d’une unité de formation et de recherche peut interdire provisoirement l’accès aux locaux universitaires à un membre du personnel du centre hospitalier universitaire. Le directeur général du centre hospitalier universitaire peut, dans les mêmes conditions, interdire l’accès des terrains et des bâtiments ou services hospitaliers à un membre du personnel de l’université ou d’une unité de formation et de recherche. L’autorité qui a pris la mesure en donne immédiatement avis à l’autorité normalement responsable, en vue d’un examen conjoint de la situation.

Si l’infraction au règlement a été commise par un étudiant, le responsable de l’application du règlement en saisit le directeur de l’unité de formation et de recherche intéressé.

Exceptionnellement et dans les cas graves, le directeur général du centre hospitalier universitaire peut interdire provisoirement au fautif l’accès sur les terrains et dans les bâtiments ou services hospitaliers. Le directeur de l’unité de formation et de recherche intéressé en est immédiatement informé en vue d’un examen conjoint de la situation.
