Article R6144-83 of the French Public Health Code

When the Medical Commission or the Social Committee are aware of facts likely to have a worrying and prolonged effect on the situation in the establishment, they may, by a two-thirds majority of the members of each of these bodies, ask the Director to provide them with explanations. The matter is then automatically placed on the agenda for the next meeting of the Commission and the Committee.

After hearing the Director, the Commission and the Committee may, by the same qualified majority, entrust two of their respective members with the task of drawing up a joint report.

The report concludes by issuing an opinion on the advisability of referring its conclusions to the Board of Directors with a view to implementing the audit procedure provided for in Article R. 6143-31.

In the light of this report, the Medical Committee and the Social Committee may decide, by the same qualified majority, to proceed with this referral.

Lorsque la commission médicale ou le comité social ont connaissance de faits de nature à affecter de manière préoccupante et prolongée la situation de l’établissement, ils peuvent, à la majorité des deux tiers des membres de chacune de ces instances, demander au directeur de leur fournir des explications. La question est alors inscrite de droit à l’ordre du jour de la prochaine séance de la commission et du comité.

Après avoir entendu le directeur, la commission et le comité peuvent confier, à la même majorité qualifiée, à deux de leurs membres respectifs le soin d’établir un rapport conjoint.

Le rapport conclut en émettant un avis sur l’opportunité de saisir de ses conclusions le conseil d’administration en vue de la mise en oeuvre de la procédure d’audit prévue à l’article R. 6143-31.

Au vu de ce rapport, la commission médicale et le comité social peuvent décider, à la même majorité qualifiée, de procéder à cette saisine.
