Reports drawn up in the course of investigations or inspections shall state the nature, date and place of the observations made. They are signed by the investigator or inspector and the person concerned by the investigations. If the latter refuses, this is noted in the report.
When the investigators or inspectors obtain explanations on site, a separate report is drawn up from the visit report. These minutes state that the person interviewed has been informed of his or her right to be assisted by counsel of his or her choice and that he or she has waived the time limit provided for when summoned.
When the investigators or inspectors have heard the person concerned by videoconference or audioconference, the audiovisual or sound recording to which these operations give rise is the subject of a transcript submitted to the person concerned for signature. This report, together with the recording, shall be sent to the person concerned within one month of the date of the videoconference or audioconference.
When the investigators or inspectors use an assumed identity within the meaning of Article L. 621-10-1 in order to consult a website on which the persons and entities mentioned in II of Article L. 621-9 provide their services, they draw up a report on the procedures for consulting and using this site, the responses obtained and their findings. The pages of the site that were consulted are appended to the report. This report is sent to the person or entity concerned before the end of the investigation or inspection.
