Article R621-37-1-1 of the French Monetary and Financial Code

The notification referred to in the first paragraph of III ofArticle L. 621-13-6 shall include all the details and information relating to the measure taken pursuant to I or II of the same article, in particular:

1° The identity of the person or persons to whom it has been sent;

2° The reasons for the measure;

3° The content of the limits imposed, in particular:

a) The person concerned;

b) The financial instruments or units referred to in the article L. 229-7 of the Environment Code concerned;

c) Any limits on the size of positions that the person may hold at any time;

d) Any exemptions granted in accordance withArticle L. 420-12 and the reasons for these exemptions.

Notification shall be made no later than twenty-four hours before the measures taken pursuant to I or II of Article L. 621-13-6 are due to take effect or, if this is not possible and by way of exception, within a shorter period.

La notification mentionnée au premier alinéa du III de l’article L. 621-13-6 comprend l’ensemble des éléments et informations relatifs à la mesure prise en application du I ou II du même article, notamment :

1° L’identité de la ou des personnes auxquelles elle a été adressée ;

2° Les motifs de la mesure ;

3° La teneur des limites imposées notamment :

a) La personne concernée ;

b) Les instruments financiers ou les unités mentionnées à l’article L. 229-7 du code de l’environnement concernés ;

c) Les éventuelles limites concernant la taille des positions que la personne peut détenir à tout moment ;

d) Les dérogations éventuellement accordées conformément à l’article L. 420-12 et les motifs de ces dérogations.

La notification est effectuée au plus tard vingt-quatre heures avant la prise d’effet prévue des mesures prises en application du I ou II de l’article L. 621-13-6 ou, en cas d’impossibilité et à titre exceptionnel dans un délai plus court.
