Article R6323-10-2 of the French Labour Code

Requests for professional transition leave which cannot all be satisfied by the employer are considered in the following descending order of priority:

1° Requests which have already been submitted and which have been deferred;

2° Requests made by employees whose training course has had to be interrupted for legitimate reasons, after consulting the social and economic committee where it exists;

3° Requests made by employees with a level of qualification lower than level IV;

4° Requests made by the longest-serving employees in the company;

5° Requests made by employees who have never benefited from professional transition leave.

Les demandes de congés de transition professionnelle qui ne peuvent être toutes satisfaites par l’employeur sont retenues suivant l’ordre de priorité décroissante suivant :


1° Les demandes déjà présentées et qui ont été différées ;


2° Les demandes formulées par les salariés dont l’action de formation a dû être interrompue pour des motifs légitimes, après avis du comité social et économique lorsqu’il existe ;


3° Les demandes formulées par les salariés ayant un niveau de qualification inférieur au niveau IV ;


4° Les demandes formulées par les salariés les plus anciens dans l’entreprise ;


5° Les demandes formulées par les salariés n’ayant jamais bénéficié d’un congé de transition professionnelle.
